1. Overview and Agreement to Terms

This website is operated by Hizanaz Ltd. Throughout the site, the terms “we”, “us”, and “our” refer to Hizanaz Ltd. We offer this website, including all information, tools, and services, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

  • Binding Agreement: By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including our Refund & Returns Policy and Privacy Policy, which are incorporated herein by reference. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and content contributors.

2. Terms of Sale for Custom-Made Garments

Our business model is based on creating custom-stitched formal wear. The following terms are critical to understanding the nature of your purchase.

  • Bespoke Goods & Cancellation Rights: All formal wear from Hizanaz Ltd. is custom-stitched to the specific measurements and/or design choices you provide. Under the UK Consumer Contracts Regulations 2013, the normal 14-day "cooling-off period" for online purchases does not apply to goods that are "made to the consumer's specifications or are clearly personalised". Because our products are bespoke and created uniquely for you, we cannot offer refunds or exchanges for non-faulty items. This includes returns for reasons such as a change of mind, incorrect measurements provided by you, or dissatisfaction with a design you chose.

  • Your Statutory Rights for Faulty Goods: The policy above does not affect your statutory rights under the Consumer Rights Act 2015 if goods have a genuine manufacturing fault. All goods, including custom-made items, must be of satisfactory quality, fit for purpose, and as described. A blanket "no refunds" policy is illegal, and we are committed to providing a remedy for any faulty items we supply.

  • Customer's Responsibility for Accuracy: You are solely responsible for providing current, complete, and accurate purchase information, including your body measurements and customisation choices. We strongly advise you to double-check all details before finalising your order.

3. Quality, Returns, and Refunds

Our Refund & Returns Policy provides full details on quality standards, what constitutes a fault, and the process for returns. It is a binding part of this agreement.

  • Quality & Craftsmanship: Each garment is a unique, custom-stitched piece, often with hand-applied details. Due to this artisanal process, minor variations or imperfections (such as a single loose thread) are a normal and inherent part of the product's character and are not considered manufacturing faults.

  • Definition of a Fault: Our Refund & Returns Policy contains a detailed Defect Classification Table that transparently outlines what is considered a Major Defect (e.g., an open seam, a broken zipper, incorrect dimensions) versus an acceptable Minor Imperfection. This table serves as the standard for assessing all claims.

  • Process for Faulty Items: If you believe your garment has a manufacturing fault, you must contact us within 30 days of receipt with your order number and clear photographic evidence. Our team will assess the claim against our Defect Classification Table.

  • Remedies for Faulty Goods: In line with the Consumer Rights Act 2015, if a Major Defect is confirmed, we will first offer to repair the item or provide a replacement/remake at our cost. A refund will only be issued if a repair or replacement is impossible, unsuccessful, or not completed in a reasonable time.

4. International Orders

  • International Returns and Customs Duties: For customers outside the United Kingdom, you are responsible for all costs associated with returning an item, including return shipping fees and any import duties or taxes. If a refund is issued, it will cover the cost of the item only. We will not refund original shipping costs or any customs duties, VAT, or other taxes you paid to your local authorities on import. It is your responsibility to seek reimbursement for such fees from your local customs authority.

5. General Conditions of Service

  • Right to Refuse Service: We reserve the right to refuse service to anyone for any reason at any time. We also reserve the right to refuse, limit, or cancel any order you place with us, including orders that appear to be placed by dealers, resellers, or distributors.

  • User Eligibility: By agreeing to these Terms, you represent that you are at least the age of majority in your country, state, or province of residence, or that you have given us your consent to allow any of your minor dependents to use this site.

  • Data Transmission: You understand that your content (not including credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer.

  • Prohibited Uses: You may not use our products for any illegal or unauthorised purpose, nor may you violate any laws in your jurisdiction (including copyright laws).   • Product Sourcing Disclaimer: Our products are sourced from trusted distributors in Pakistan. While we strive to ensure the authenticity of all items, we cannot guarantee every product is an original branded item. We are committed to sourcing high-quality garments from reputable suppliers.

  • Modifications and Prices: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any product) at any time without notice.

  • Information Accuracy: We are not responsible if information on this site is not accurate, complete, or current. The material is for general information only. Occasionally, there may be typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, and availability. We reserve the right to correct any errors and to cancel orders if any information is inaccurate at any time, without prior notice (including after you have submitted your order).

7. Third-Party Links and Tools

This site may provide you with access to third-party tools or link to third-party websites that are not affiliated with us. We do not monitor and have no control over these external resources.

  • We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites.

  • Indemnification: You agree to indemnify and hold harmless Hizanaz Ltd. and our directors, employees, and affiliates from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law.

  • Disclaimer of Warranties; Limitation of Liability: Your use of our Service is at your sole risk. The Service and all products are provided 'as is' and 'as available' without any warranties, express or implied. In no case shall Hizanaz Ltd. be liable for any direct, indirect, special, or consequential damages of any kind. This does not, however, limit or exclude our liability for matters that cannot be limited or excluded under applicable law, such as your statutory rights under the Consumer Rights Act 2015.

  • Severability: If any provision of these Terms is determined to be unlawful or unenforceable, that provision shall be deemed severed, and the determination will not affect the validity and enforceability of any other remaining provisions.

  • Entire Agreement: These Terms of Service and any policies posted by us on this site (including the Refund & Returns Policy) constitute the entire agreement between you and us, superseding any prior agreements.

  • Governing Law and Jurisdiction: This agreement and any dispute arising from it shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.

In addition to other prohibitions in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, or laws; (d) to infringe upon our intellectual property rights or the rights of others; (e) to harass, abuse, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect the personal information of others; (i) to spam, phish, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
